Baby Doe was born out of wedlock. Baby had sever birth defects allegedly caused by improper birthing procedures by the physicians and hospital involved. The mother who had sole custody brought a lawsuit and recovered a substantial sum.
The recovery was placed in a Special Needs Trust by the court for the care of the baby. Baby lived five years in the custody of the mother and then passed away, leaving a substantial estate. The father came into our office and indicated he felt he had inheritance rights.
